ANTI-CORRUPTION LAW SERIES-44 Latest Case law-{07/02/2019} MADAN MOHAN MAHTO Vs STATE OF JHARKHAND Indian Penal Code, 1860, Section 302 and 34, The Constitution of India, Article 136. SC observed, when the two Courts below in their respective jurisdiction have appreciated the entire ocular evidence, then this Court would be very slow in exercise of its appellate jurisdiction under Article 136 of the Constitution to appreciate the evidence afresh unless the appellants are able to point out that the concurrent finding of two Courts below is wholly perverse or is recorded without any evidence or is recorded by misreading or ignoring the material evidence. SC held, it was proved that all the accused came together armed with lethal weapons in their hands with an intention to attack the persons working in the field. ANTI-CORRUPTION LAW SERIES-43 Latest Case law-(06/02/2019) SHIVNARAYAN Vs MANIKLAL & ORS. Sections 16 and 17 of the C.P.C The suit filed by the plaintiff for Indore property as well as Bombay property was based on different causes of action and could not have been clubbed together. Section 16 contains general principle that suits are to be instituted where subject-matter is situated whereas Section 17 engrafts an exception to the general rule as occurring in Section 16. SC held, the trial court was justified in holding that plaintiff has clubbed different causes of action which is to be deleted from the present suit. The plaintiff was not justified in including different properties and separate cause of actions combining in single suit. Appeal is dismissed. Ashok Bhushan, K.M. Vs MOHAN VARMA & ORS Kerala Compensation for Tenants Improvements Act 1958, Sections 4 and 5, Code of Civil Procedure, 1908, Order XXI Rules 97 to 101. SC held that the High Court was justified in coming to the conclusion that the failure of the appellants to raise a claim would result in the application of the principle of constructive res judicata both having regard to the provisions of Sections 4 and 5 of the Act of 1958 and to the provisions of Order XXI Rules 97 to 101 of the CPC.
